Florida Probate: What is a Summary Probate Administration?

A Summary Probate Administration is an option if the deceased person’s probate assets do not exceed $75,000 or if it has been more than two (2) years since the deceased person’s death. This type of probate administration may be ideal for probate estates in which there are no creditors, limited probate assets, and there is an agreement amongst the beneficiaries.


An interested person may initiate a Summary Probate Administration by filing a Petition for Summary Administration. This petition informs the court about the basic information regarding the deceased person, probate assets, and beneficiaries of the estate, and requests the court to enter an order directing that the probate assets be transferred to the beneficiaries of the estate.


Generally, a Summary Probate Administration takes one (1) to three (3) months to complete.
